1. Agreement to Terms

By accessing or using LeadProc ("Service," "we," "us," "our"), you agree to be bound by these Terms of Service ("Terms"). If you disagree with any part of these Terms, you may not access the Service.

LeadProc is operated by LeadProc ("Company"). These Terms apply to all users, including business owners who subscribe to the Service.

2. Description of Service

LeadProc provides a missed call interception and lead management service for home service businesses. The Service includes:

  • A dedicated phone number for call forwarding
  • Automated voicemail recording and AI-powered transcription
  • SMS and email notifications to subscribed business owners
  • Lead scoring and extraction powered by artificial intelligence
  • Callback bridging functionality via SMS reply commands

3. SMS Messaging Terms

3.1 Consent to Receive SMS

By signing up for LeadProc, you expressly consent to receive automated SMS text messages from LeadProc at the phone number you provide during registration. These messages include:

  • Missed call alert notifications
  • Lead details and voicemail transcriptions
  • Follow-up reminders for pending leads
  • Weekly performance summaries
  • Service and account notifications

3.2 Message Frequency

Message frequency varies based on the number of missed calls your business receives. You may receive multiple messages per day during active business hours.

3.3 Opting Out

You may opt out of receiving SMS messages at any time by replying STOP to any message. After opting out, you will receive a single confirmation message. You will no longer receive SMS alerts until you re-subscribe.

3.5 Message & Data Rates

Standard message and data rates may apply depending on your mobile carrier and plan. LeadProc is not responsible for any charges incurred from your carrier.

3.6 Carrier Disclaimer

Carriers are not liable for delayed or undelivered messages.

4. Accounts and Registration

To use the Service, you must create an account and provide accurate, complete information. You are responsible for maintaining the confidentiality of your account credentials and for all activity under your account. You must notify us immediately at zach@leadproc.com of any unauthorized use.

You must be at least 18 years old and have the authority to bind any business entity you represent to these Terms.

5. Billing and Payments

Subscription fees are billed monthly or annually in advance. All fees are non-refundable except as required by law. We use Stripe to process payments. By providing payment information, you authorize us to charge your payment method for all fees.

We reserve the right to change our pricing with 30 days' notice. Continued use after a price change constitutes acceptance of the new pricing.

Your free trial period (if applicable) will automatically convert to a paid subscription at the end of the trial unless cancelled before the trial ends.

6. Cancellation

You may cancel your subscription at any time from your account settings. Cancellation takes effect at the end of your current billing period. You will retain access to the Service through the end of the paid period. We do not provide pro-rated refunds for partial periods.

7. Acceptable Use

You agree not to use the Service to:

  • Send unsolicited commercial messages (spam)
  • Harass, threaten, or harm any individual
  • Violate any applicable laws or regulations, including the TCPA
  • Intercept calls without the caller's knowledge in violation of applicable wiretapping laws
  • Misrepresent your identity or business
  • Attempt to reverse engineer or compromise the Service

You are solely responsible for ensuring your use of the Service complies with all applicable federal, state, and local laws, including laws governing call recording and interception in your jurisdiction.

8. Call Recording Disclosure

The Service records voicemail messages left by callers. You are responsible for ensuring that your use of call recording complies with all applicable laws in your jurisdiction. Many states require all-party consent for recording. By using the Service, you represent that your use of call recording is lawful and that callers are notified of recording through the greeting message.

9. Intellectual Property

The Service and its original content, features, and functionality are owned by LeadProc and are protected by international copyright, trademark, patent, trade secret, and other intellectual property laws.

You retain ownership of your data, including voicemail recordings and transcriptions generated from your account. You grant LeadProc a limited license to process this data solely to provide the Service.

10. Disclaimers and Limitation of Liability

THE SERVICE IS PROVIDED "AS IS" WITHOUT WARRANTY OF ANY KIND. WE DISCLAIM ALL WARRANTIES, EXPRESS OR IMPLIED, INCLUDING MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT.

IN NO EVENT SHALL LeadProc BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING LOST PROFITS OR LOST LEADS, ARISING FROM YOUR USE OF THE SERVICE.

OUR TOTAL LIABILITY TO YOU SHALL NOT EXCEED THE AMOUNT YOU PAID TO US IN THE THREE MONTHS PRECEDING THE CLAIM.

11. Indemnification

You agree to indemnify and hold harmless LeadProc, its officers, directors, employees, and agents from any claims, liabilities, damages, and expenses (including attorneys' fees) arising from your use of the Service or violation of these Terms.

12. Termination

We may terminate or suspend your account immediately, without prior notice, for conduct that we believe violates these Terms or is harmful to other users, us, or third parties, or for any other reason at our sole discretion.

13. Governing Law

These Terms are governed by applicable law. Any disputes shall be resolved through binding arbitration or in a court of competent jurisdiction.

14. Changes to Terms

We reserve the right to modify these Terms at any time. We will notify you of material changes by email or a prominent notice on our website at least 30 days before the change takes effect. Continued use after changes constitutes acceptance.
